Swamy's salvo against Sonia

        It is reported that Dr Subramaniyam Swamy is going to challenge the nomination of Sonia Gandhi today in the by-election to be held on May 8, 2006 in Rae Bareli Lok Sabha Constituency. He is challenging her nomination as invalid on the following grounds:

        (1) In the Register of Citizens of those granted Indian Citizenship under Section 5 of the Citizenship Act (1955), there is no person entered by name of Ms Sonia Gandhi. Hence, Ms Gandhi may be asked to produce her Indian citizenship certificate. Indian passport, the Supreme Court has held, is no proof of citizenship.

        (2) Under the proviso to Section 5 of the Citizenship Act, Ms. Sonia Gandhi even if she is a citizen of India by registration is not entitled to contest a Lok Sabha election because in Italy only natural born citizens are entitled to contest elections. Hence, by the proviso of Section 5 of the Citizenship Act, she is disentitled to be a candidate for election to Lok Sabha since she is not a natural born citizen.

        (3) Ms. Sonia Gandhi's affidavit attached to her nomination forms are materially incomplete or misleading. It is a mandatory requirement for her to truthfully attest to her educational qualification. Ms Gandhi has claimed her education as 'certificate in English from Lennox Cook School, Cambridge, UK' There is no such School in the city of Cambridge. A search of the web-site 'cambridgeonline.ac.uk.' the authontative website of the city, there is no such educational institution. However a Lennox Cook School that had existed pre-1991 is listed under shop establishments category and not an approved educational institution. Hence, it is false to claim this certificate as educational qualification, and hence is an offence of perjury under section 177 of the IPC and Section 125A of the RPA (1951).

        (4) Moreover Ms. Gandhi had in her 2004 affidavit for Lok Sabha, claimed to be educated in the University of Cambridge, UK but this claim has been dropped. Hence it is admission of perjury by Ms Gandhi. She is thus faltering, fumbling, shifting and shuffling in the presentation of her academic credentials.

        (5) Ms. Gandhi claims to own share in a company Western Tanneries Ltd. This company was closed down during the period of the Janata Party Government. The Company was accused of slaughtering cows which is violative of the Directive Principles of the Constitution.

        Is it not shameful for Sonia Gandhi, that her academic credentials are being questioned by Dr Subramaniyam Swamy, the former Law and Commerce Minister of India? Very unfortunately for Sonia and her bonded henchmen in her party, the academic credentials of Dr Subramaniyam Swamy are impeccable. When I see some of the Indian politicians like Sonia Gandhi parading their doubtful academic degrees, I cannot help referring to the salutary example of Sir Winston Churchill. Sir Winston Churchill never went to a college or University, nor did he ever claim to have done so. Nevertheless he won the Nobel Prize for Literature, quite unlike our treacherous congressmen wangling Padma Awards for themselves through their sordid political influence. At a convocation function in one of the famous American Universities, Sir Winston Churchill observed: 'I have received more number of degrees than I have passed exams'. But then he derived his inner strength from himself and not from external trappings like offices of profit, or offices of non-profit. And of course he did not have a questionable citizenship! I am compelled to state this in spite of the fact that examples of this kind are totally irrelevant in the murky context of criminalized Indian Politics today.

        After surveying what is going on at the highest levels of governance in New Delhi under the puerile leadership of a directionless Prime Minister acting under the arbitrary commands of a de facto Prime Minister who fancies herself to be on par with Catherine the Gate of Russia, I would like to recall the following words of a 'non-communal' and of course 'non-saffronized' leader of everlasting fame like Abraham Lincoln:

        'Let reverence for the Laws be breathed by every American mother to the lisping babe that prattles on her lap; let it be taught in schools, in seminaries, and in colleges; let it be written in primers, spelling books and almanacs; let it be preached from the pulpit, proclaimed in Legislative Halls, and enforced in Courts of Justice. And, in short, let it become the political religion of the nation; let the old and the young, the rich and the poor, the grave and the gay of all sexes and tongues and colours and conditions, sacrifice unceasingly upon its altars'.

        The anti-Hindu majority UPA Government today seems to have substituted the words 'unabashed lawlessness' for the word 'Law' in the above quotation. Lawlessness of MPs, Cabinet Ministers, Governors, State Ministers, MLAs and public servants at all levels has become all pervading —all deriving their inspiration and sanction from Sonia Gandhi. Her exemplary political misdemeanour always sets the tone for the UPA Government to create, promote and institutionalize an environment of lawlessness, deriving its mandate from the secular Law of Coalition Adharma which declares that the survival of the Indian Nation means survival of the Sonia family with or without UPA coalition.

        It is a public tragedy that the Election Commission consisting of men like Navin Chawla (a proclaimed tout of the Congress Party) is functioning as an executive handmaid of the UPA Government even as Sonia Gandhi is functioning as a political handmaid of the UPA Government. The UPA Government expects the Election Commission as a matter of course to function as an utterly partial accomplice or assistant or adjutant. UPA for Sonia means 'unquestioningly private affair'. I am not therefore surprised that the Election Commission has so far chosen to ignore the fundamental Constitutional point relating to citizenship raised by Dr Subramaniyam Swamy. The verification of a fact or otherwise relating to Sonia Gandhi's academic credentials, which seems to have been done with some finesse and precision by a private citizen of some national significance like Dr Subramaniyam Swamy, might well have been done independently as a matter of public duty by the Election Commission of India. The fact that it has chosen to remain silent or neutral only shows that all the moribund public institutions in India are worried only about the dead carcass of law and not the spirit of law. Most of the public institutions in India today have conveniently forgotten the fact that all public laws are made not for particular or individual cases but for all men in general.

        India is slowly moving towards a land of fascist tyrants. The Laws of a free society have to be distinguished from the edicts of a tyrant or the regulations of a totalitarian State. Laws protect liberty so long as certain inalienable individual rights are secure, as long as the law makers represent the community, as long as the courts are free to interpret the Laws without coercion, and as long as there are political means available to revise Laws that are repressive or unjust. These thoughts are coming in a rush to my mind because a handful of selected VVIPs like Sonia Gandhi belonging to some political parties or certain selected political families in India are more protected than the King of England. I know it will be well understood without any effort on my part to underline the 'selected political family', in Tamilnadu or as indeed elsewhere in the Country. Here, the words of Honourable Justice Learned Hand of America become strikingly evident: 'If we are to keep our democracy, there must be one commandment: Thou shall not ration justice'.

        All the people of India created a 'Father of the Nation' in Mahatma Gandhi. Now the Congress party is trying to create a 'Mother of the Nation' in Sonia Gandhi!! Thus the Upanishadhic Prayer has been totally reversed by the Congress party today: 'Lead me from truth to untruth, from real to the unreal, from British to Italian, from Protestant to the Catholic, from Mahatma Gandhi to Sonia Gandhi, from Bharat Mata to Sonia Mata, from uncertain immortality to known and definite death'.
