Chennai: Hours after the Madurai bench of Madras High Court said its permission was not required, the Tamilnadu Government on Monday night issued an order transferring the Sathankulam father-son duo custodial deaths investigation to the CBI.
The GO, which was published in the Government gazette with the consent of the Governor under Sec 6 of the DelhiSpecial Police Establishment Act, 1946 (Central Act 25 of 1946), said the Director General of Police requested the government to order transferring the case to CBI to facilitate a free and fair investigation.
The Madurai bench of the High Court, which has taken suo motutaken cognisance of the custodial deaths that occurred allegedly due to police torture, observed that it was the policy deicison of the State government to transfer the case to the CBI.
“The Government after careful consideration, have decided to accept the reqeust of the SGP and to transfer the case foirinvestigation by the CBI by issuing a notification under Sec 6 of the Delhi Special Police Establishemnt Act, 1946”, the GO said.
The GO was issued in line with Chief Minister Edappadi K Palaniswmai’s announcement that the state government has decided to transfer the probe to the CBI.
