Chennai: The Madras High Court today quashed the government order recommending DVAC enquiry against DMK president M K Stalin and treasurer M Durai Murugan in connection with the alleged irregularities in the construction of the new Secretariat building in Omandurar Government Estate.

The order was issued based on a plea filed by Stalin and Durai Murugan challenging the G.O. issued in September transferring the probe to the DVAC.

The judges said an enquiry cannot be ordered based on an inconclusive findings of a Commission of Inquiry.

The project initiated by former chief minister late M Karunanidhi was later converted into a multi-super-speciality hospital by former Chief Minister J Jayalalithaa in 2011.

Probing of the alleged irregularities was handed over to the Justice R Ragupathy Commission by the government in 2011. However it became defunct after the court passed an order based on the pleas moved by Karunanidhi, Stalin and Durai Murugan.

The case was taken up after three years by a single judge who censured the government for spending more than Rs 2 crore on the defunct commission. Subsequently, Justice Ragupathy resigned from the commission.
