Chennai: A petition filed by AIADMK alliance candidate A C Shanmugam, seeking a stay on the cancellation of Vellore Lok Sabha election, came up for hearing in the Madras High Court today.
The judges questioned whether the petitioner wants the election to be conducted by permitting the candidate who had allegedly given money. In response to this, the petitioner’s advocate asked the judges to disqualify the particular candidate and hold the election.
However, the Court said according to the Representation of The People Act, it was not possible to disqualify a candidate.
Election in Vellore Lok Sabha constituency was cancelled yesterday following recovery of huge amount of cash allegedly from a DMK functionary’s office. President Ram Nath Kovind rescended the election notification for the seat based on the recommendation by the Election Commission.
The EC took the decision after the district police had filed a complaint against DMK candidate Kathir Anand, as well as two party functionaries on the basis of a report from the Income Tax department on 10 April.
