Chennai: The Madras High Court has issued notice to the Centre and Tamilnadu government, seeking a reply on the petition filed by the DMK in the 10 per cent reservation case for economically weaker sections (EWS).
The notice is returnable in two weeks.
With the Centre recently passing the Act that gives 10 per cent reservation for people from EWS in education and employment, it led to dissatisfaction in Tamilnadu which already has 69 per cent quota for socially backward and oppressed castes.
The DMK took the case to court, challenging the Act, stating that reservation was meant for the socially downtrodden and that Tamilnadu already had 69 per cent reservation. According to the Supreme Court judgement, reservation cannot exceed 50 per cent but the TN quota has been added to Ninth Schedule of the Constitution which means no court can pass any order on it.
The court today issued notices to the Centre and State government to file its reply in two weeks’ time on the DMK plea.
