Madras HC stays transfer counselling for govt school teachers

Chennai: The counselling process for transfer of government school teachers in the State was stayed by the Madras High court yesterday. The interim order was passed by Justice V Parthiban. 

More than 100 petitions came up for hearing before the court. The petitioners sought the 20 June last Government Order (GO) of the School Education Department to be quashed.

The government school teachers opposed a condition in the GO that teachers who were promoted on or before 1 June 2017 alone were permitted to participate in the counselling for transfer.

Clause 9(i) of the impugned order stated that the teachers who are working for the period of three years in the same school as on 1 June 2019 would be allowed to participate in the counselling. Because of the clause, despite vacancies in schools near their houses, the petitioners were unable to attend the counselling. The conditions imposed in the GO were illegal, arbitrary, unjust and against the rights guaranteed to the petitioner in the service law, said the teachers in their petitions.
