The Madras High Court on Monday dismissed a public interest litigation challenging the Speaker’s decision to accept the resignations of six AIADMK MLAs after the petitioner withdrew the case.
The six MLAs had resigned from the AIADMK and joined the Tamilaga Vettri Kazhagam (TVK). AIADMK whip Agri Krishnamoorthy has already approached the High Court challenging their resignations, and arguments in the case have commenced.
The PIL was filed by Madurai-based P.G. Chandrasekaran challenging the Speaker’s decision to accept the resignations. The case came up before a Division Bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan.
The Bench questioned the need for multiple petitions on the same issue when a case filed by the concerned political party was already being heard and arguments had begun.
The judges observed that one case should be sufficient to address an issue and questioned whether successive petitions would dilute the pending proceedings.
After the Bench warned that the petition could be dismissed with costs, the petitioner’s counsel sought permission to withdraw it. The court allowed the withdrawal and dismissed the petition.
