Former Ambasamudram AIADMK MLA Isakki Subbaya has sought permission to withdraw his resignation and continue as a legislator, even as the Madras High Court considers a challenge to the acceptance of resignations submitted by six AIADMK MLAs.
Subbaya has written to the Tamil Nadu Legislative Assembly Secretary requesting that his resignation should not be acted upon and that he should be allowed to continue representing the Ambasamudram constituency.
Subbaya had resigned from the Assembly after the 2026 election and subsequently joined the ruling TVK. He has now sought to reverse that decision, citing the need to ensure representation for his constituency.
The request came during the hearing of the case challenging the Speaker’s acceptance of the resignations of AIADMK MLAs. Subbaya also informed the High Court that he had approached the Speaker seeking permission to continue as MLA until the court decides the election-related petitions.
However, the Assembly Secretary’s position is that there is no provision to withdraw a resignation once it has been accepted and the constituency has been officially declared vacant.
The Ambasamudram seat has consequently been treated as vacant and can now be filled only through the electoral process.
The High Court also declined to entertain Subbaya’s fresh plea during Tuesday’s proceedings and reserved orders on the main case.
The development has added another layer to the legal and political dispute surrounding the resignations of AIADMK MLAs who subsequently moved to the TVK.
