Chennai, Sept. 4:
The DMK will continue to pursue its legal challenge concerning alleged defects in electronic voting machines used in the Kolathur Assembly constituency, party legal wing secretary N R Elango said on Thursday.
Speaking to reporters, Elango said the party had earlier approached the Supreme Court with evidence concerning defective EVMs.
He claimed that of 19 EVMs examined by the Election Commission, 14 were found to be functioning properly, while the DMK had established that five machines had defects.
The party, he said, had sought verification of all EVMs used in the Kolathur constituency and counting of the VVPAT slips.
Elango said the party had also sought a declaration that DMK president M K Stalin had been elected from the constituency.
He said the Madras High Court had held that the plea seeking a declaration of the election result could not be sustained in its present form, but had permitted the party to approach the appropriate court with regard to verification of 100 per cent of the EVMs.
The DMK legal wing would place the matter before the party leadership and seek instructions to take the issue to the Supreme Court, he said.
Elango also argued that the legal framework governing election disputes had not been adequately updated to address issues concerning EVM malfunction. He said the party would continue pursuing the matter in the Supreme Court.
