NEW DELHI:
The Supreme Court has taken cognizance of remarks made by the Patna High Court in a rape case, amid concerns over observations concerning the alleged sexual assault of a woman.
A Bench of the Supreme Court took up the matter after the observations made in the July 9 judgment came under scrutiny. The case relates to proceedings in which the Patna High Court had examined whether the prosecution had established the allegations against the accused.
The Supreme Court’s intervention comes amid renewed focus on the manner in which courts deal with cases involving sexual offences and the language used while recording findings and observations.
The development is being closely watched as the apex court considers the legal and judicial implications of the observations made by the High Court.
