SC to review Madras High Court ruling on child pornography

The Supreme Court of India has taken a significant step towards addressing concerns over the legal interpretation of child pornography laws by agreeing to review a controversial ruling issued by the Madras High Court. Chief Justice of India DY Chandrachud’s bench issued a notice regarding the matter, signaling the court’s intention to scrutinize the ruling, which held that downloading and possessing child pornography does not constitute a crime.
Expressing dismay over the Madras High Court’s judgment, Chief Justice Chandrachud questioned its validity, emphasizing the existence of clear provisions within the law pertaining to such offenses. “This (the high court judgment) is atrocious. How can the single judge say this? Issue notice returnable in three weeks,” remarked the CJI, highlighting the gravity of the issue at hand.
The bench, comprising Chief Justice Chandrachud and justices JB Pardiwala and Manoj Misra, took cognizance of the submissions made by two petitioner organizations during the proceedings. The NGOs, Just Rights for Children Alliance and Bachpan Bachao Andolan, represented by Senior Advocate HS Phoolka, argued that the high court’s ruling contradicted established laws and posed a threat to child protection efforts.
The intervention of the Supreme Court follows a ruling by the Madras High Court in January, which asserted that the mere act of downloading and watching child pornography does not constitute an offense under the Protection of Children from Sexual Offences (POCSO) Act and the Information Technology Act. This ruling sparked widespread concern and debate, prompting calls for judicial review and clarification on the legal framework surrounding child pornography offenses.
The petition lodged by the two NGOs underscores the urgency and significance of addressing the legal ambiguity surrounding child pornography laws. By challenging the Madras High Court’s ruling, the petitioners seek to uphold the integrity of existing legislation and ensure robust safeguards for children against exploitation and abuse.
