Apex court dismisses OPS’ plea against HC order

In a recent development, the Supreme Court of India has dismissed the plea filed by former Tamil Nadu Chief Minister O Panneerselvam challenging the Madras High Court’s decision to re-examine his discharge in a disproportionate assets case. The bench comprising of Justices Hrishikesh Roy and P K Mishra rejected the Special Leave Petition, emphasizing that the observations made by the High Court would not influence the final decision in the criminal revision.
O Panneerselvam, a prominent leader of the All India Anna Dravida Munnetra Kazhagam (AIADMK), had approached the Supreme Court against the Madras High Court’s order, which was initiated by a single-judge bench led by Justice Anand Venkatesh. The High Court had taken suo motu action to reconsider the order discharging Panneerselvam in the aforementioned case.
During the proceedings, senior advocate Jaideep Gupta, representing Panneerselvam, highlighted that the prosecution had withdrawn the case, suggesting that there was no basis for the High Court to revisit the matter. However, the Supreme Court, after examining the High Court’s order, stated that there were sufficient grounds to justify the initiation of such a revision.
The case pertains to allegations of disproportionate assets against O Panneerselvam. Despite the prosecution withdrawing the case, the Madras High Court deemed it necessary to re-examine the discharge order, prompting Panneerselvam to appeal to the Supreme Court.
