The Supreme Court has ordered a partial stay on some provisions of the Waqf Amendment Act. Tamil Nadu Chief Minister M.K. Stalin has welcomed this move.From the time the amendment was brought in Parliament, the DMK opposed it strongly. Stalin said the provisions struck down by the Supreme Court were made by the BJP government at the Centre and went against the rights of the Muslim community.
The court stayed rules that required Waqf property to be in use for five years before recognition, allowed seizure of Waqf lands claimed as government property, and gave power to district collectors to cancel Waqf status of long-used religious properties. It also stopped provisions that would have increased the number of non-Muslim members in Waqf boards, ensuring Muslims remain the majority.
Stalin said the judgment protected the fundamental rights of minorities under the Constitution. He also recalled that the Tamil Nadu Assembly had already passed a resolution urging the Centre to withdraw the Act.
