As India accelerates its adoption of artificial intelligence across sectors, from finance to healthcare and government services, a crucial question emerges: is our governance framework keeping pace with technology? A government‑backed white paper has flagged serious concerns, noting that India’s current approach to AI governance is fragmented, reactive and vulnerable to misuse rather than proactive and robust. The report warns that existing laws like the Information Technology Act and the Digital Personal Data Protection Act were not designed for AI’s complexity, leaving gaps in early risk detection and preventive safeguards. 
One of the most troubling insights is the risk of embedded bias, data misuse and deepfake proliferation, which can spread quickly once AI systems are deployed. In many cases, harms such as discrimination or privacy breaches are only discovered after damage has occurred, because enforcement mechanisms tend to be post‑facto rather than preventative. Weak data governance—especially at the training stage of AI systems—can entrench unfair outcomes that are almost impossible to reverse, undermining public trust and amplifying social inequalities.
The white paper also highlights uneven institutional capacity as a major weakness, with smaller firms, startups and public agencies struggling to monitor AI behaviour or conduct compliance audits. Without a unified, forward‑looking regulatory strategy that integrates legal obligations into AI systems themselves, India risks AI adoption outpacing the mechanisms meant to keep it safe, fair and accountable. Strengthening governance, standardising frameworks, and building enforcement capacity are essential if India’s AI ecosystem is to be both innovative and trustworth
