The Madras High Court is currently hearing quo warranto petitions filed against three prominent political figures – Ministers Udhayanidhi and PK Sekarbabu, along with Member of Parliament A Raja. The petitioners, T Manohar, Kishore Kumar, and VP Jayakumar, all affiliated with the Hindu Munnani organisation, have raised concerns about comments made by these politicians concerning Sanatana Dharma.Senior advocate TV Ramanujam, representing one of the petitioners, argued before Justice Anita Sumanth that the Ministers and MP should not continue to hold their positions because they have allegedly violated Articles 25 and 26 of the Indian Constitution. He further contended that their actions constituted a breach of their oath of office and amounted to fraud against the Constitution. As members of a secular government, he asserted that they should not make comments that appear to undermine Sanatana Dharma.
In response, Advocate General R Shunmugasundaram questioned the maintainability of the quo warranto petitions, and senior advocate Wilson, representing Udhayanidhi, denied the merits of the petitions. The counsel also rejected the petitioner’s submission of a pen drive containing a video of the Sanatana Dharma speech, citing Section 65B of the Indian Evidence Act.
The hearing is ongoing, and due to incomplete arguments, the judge has scheduled the next hearing for today.
